1. PARTES

2. OBJETO DEL CONTRATO

This Agreement governs the sale and delivery of tourism and travel services (incluyendo pero no limitado a balloon flights, daily tours, private transfers, cultural activities, and guided excursions) offered by el Vendedor and purchased by el Comprador through electronic means.

All reservas, pagos, and related transactions made via the Skyway Travel website or mobile application are sujeto a this Agreement.

3. DESCRIPCIÓN Y PRECIO DE LOS SERVICIOS

Details such as the type, scope, duration, total price, currency, and método de pago of each service are displayed on the relevant booking page prior to confirmation.

All prices are shown in TRY (turca Lira), EUR (Euro), or USD (US Dollar), and the currency selected during checkout determines the final pago amount.

4. PAGO Y CONFIRMACIÓN

Payment must be completed at the time of booking unless a written deferred payment arrangement ha sido approved.

Upon successful pago, el Comprador will receive an electronic Reserva Confirmation and Tour Voucher by email dentro de 24 hours.

5. DERECHO DE DESISTIMIENTO

Pursuant to Article 15(g) of the Distance Sales Regulation, el derecho of withdrawal does not apply to services related to accommodation, transportation, catering, or leisure activities that must be performed on a specific date or dentro de a specific period.

However, Skyway Travel offers the following flexible cancelación policy in favor of the Buyer:

• Hot Globo Aerostático Tours: Full reembolso for cancelacións made at least 24 hours before the scheduled start time.
• Other Tours: Full reembolso for cancelacións made at least 24 hours antes del tour start time.
• No-Shows or Late Arrivals: Non-reembolsoable.
• Weather-Related Cancelacións: Full reembolso or free rescheduling, at the Buyer's choice.

Reembolsos for eligible cancelacións are processed within 5–10 business days to the original método de pago.

6. INCUMPLIMIENTO DE ENTREGA O FUERZA MAYOR

If the Seller is unable to provide the booked service due to force majeure events such as adverse weather conditions, natural disasters, government restrictions, or safety-related aviation cancelacións, the Buyer shall have the right to:

• Reprogramar el tour para otra fecha disponible,
• Cambiarlo por otro tour de igual valor, o
• Receive a full reembolso.

Skyway Travel no será responsable por pérdidas o daños causados por circunstancias fuera de su control razonable.

7. RESPONSABILIDADES DEL COMPRADOR

The Buyer must review all service details, including pickup location and time, antes del tour date.

El Comprador must comply with all safety instructions and guidelines provided by Skyway Travel's staff, pilots, or guides.

The Buyer is responsible for ensuring their own health and fitness suitability for activities such as hot globo aerostáticoing, ATV rides, or hiking.

Skyway Travel is not liable for loss or damage to personal belongings or injuries resulting from el Comprador's negligence or failure to follow instructions.

8. PROTECCIÓN DE DATOS Y PRIVACIDAD

Skyway Travel Agency Limited Company processes all datos personales in compliance with turca Datos Personales Protection Law No. 6698 (KVKK) and GDPR (where applicable).

Personal information is collected only for reserva, communication, legal compliance, and operational purposes.

9. LEY APLICABLE Y RESOLUCIÓN DE DISPUTAS

This Agreement is governed by the laws of the Republic of Turquía.

Any disputes arising from this Agreement shall be resolved by the Consumer Arbitration Committees and Consumer Courts in Nevşehir, Turquía, as per the monetary limits set by law.

Both parties acknowledge and accept the exclusive jurisdicción of these authorities.

10. VIGENCIA Y ACEPTACIÓN

By clicking the "Confirm Reserva" or "Complete Reservation" button on the Skyway Travel website, el Comprador acknowledges that they have read, understood, and agreed to this Contrato de Venta a Distancia in its entirety.

Este Contrato se ejecuta electrónicamente y es legalmente vinculante bajo la Ley No. 5070 sobre Firmas Electrónicas.
